TERMS & CONDITIONS

All sales made on www.shopatbuffalotech.com are final and subject to the terms and conditions stated herein, which are in lieu of and replace any and all terms and conditions set forth in any documents issued by customer, including, without limitation, purchase orders and specifications. In case of conflict between the terms and conditions stated here and those on the face hereof, those on the face hereof shall control. Any additional, different or conflicting terms and conditions on any such document issued by customer at any time are hereby rejected by Buffalo Technology, and any such document shall be wholly inapplicable to any sale made hereunder and shall not be binding in any way on Buffalo Technology.

Products purchased on www.shopatbuffalotech.com are not intended for resale. Buffalo Technology reserves the right to audit orders and limit quantities purchased.

Content

While Buffalo Technology uses its best efforts to provide accurate and up-to-date information, we cannot warrant that the site content is free from any errors or omissions. Upon receipt of your order, if we discover that pricing, availability or any other product information is inaccurate, we will notify you within 24 business hours of the error. At that time, you will have the opportunity of electing to proceed with your order based on the correct data or canceling. Please feel free to contact Buffalo Technology to confirm any information prior to ordering.

Product Availability

Offers are valid while supplies last. Product may not be available for immediate delivery. Customers will be notified by Buffalo Technology through the customer�s provided email address in the event a product is backordered.

Payment

Unless otherwise stated, all payments shall be due upon placement of the order. An order is officially placed when an invoice is generated. Buffalo Technology accepts MasterCard�, Visa�, American Express� and Discover Card� and there are no credit card surcharges imposed by Buffalo Technology. Please ensure the billing and shipping address information is as it appears on your credit card statement. Charges are based on U.S. dollars. We are unable to accept internationally issued credit cards. Charges are shown as Buffalo Technology on your statement.

Taxes

Unless otherwise stated on the face hereof, stated prices do not include any customs duties, sales, use, value added, excise, federal, state, local or other taxes. All such duties or taxes shall be paid by customer. Tax exempt orders cannot be placed on www.shopatbuffalotech.com due to system constraints. Please contact us at 1-800-967-0959 to place all tax exempt orders.

Delivery Terms

Orders are not binding upon Buffalo Technology until shipped by Buffalo Technology. Shipment is evidenced when a tracking number is generated.

All orders are shipped through Federal Express. Buffalo Technology will confirm shipment by emailing the customer their tracking information, the following business day after the order shipped, at the email address provided.

Memory orders placed by 3:00PM central time, Monday through Friday, will ship the same day provided the credit card is approved and items are in stock. Network and storage products ordered Monday through Friday usually ship the next business day provided the credit card is approved and items are in stock. Please allow one additional business day for weekend or holiday orders. Please allow four to five business days for processing all Refurbished product orders.

Buffalo Technology does not ship to freight forwarders, PO Boxes (in conjunction with FedEx and UPS protocol), APO, FPO or addresses outside of the United States or Canada.

Buffalo Technology is not responsible for shipping delays or other delays caused by events that are out of our control. Shipments to remote locations may take longer than the delivery method indicates.

All shipments require a signature upon delivery. A claim must be filed for all shipping discrepancies within 5 days of the order ship date from Buffalo Technology.

Title and Risk of Loss

Title to and risk of loss on all products passes from Buffalo Technology to customer upon shipment from our facility. Buffalo Technology's liability for delivery shall cease, and title and all risk of loss or damage shall pass to customer upon delivery to carrier.

DISCLAIMERS

The foregoing is the complete warranty for Buffalo Technology products and supersedes all other warranties and representations, whether oral or written. Except as expressly set forth above, no other warranties are made with respect to Buffalo Technology products and Buffalo Technology expressly disclaims all warranties not stated herein, including, to the extent permitted by applicable law, any implied warranty of merchantability or fitness for a particular purpose. In no event will Buffalo Technology be liable to the purchaser or to any user of the Buffalo Technology product, for any damages, expenses, lost revenues, lost savings, lost profits, or any other incidental or consequential damages arising from the purchase, use or inability to use the Buffalo Technology product, even if Buffalo Technology has been advised of the possibility of such damages.

Service and Support

Buffalo Technology is not liable for, and does not cover under warranty, any costs associated with servicing and/or installation of Buffalo Technology products. If you experience any difficulty during the installation or subsequent use of a Buffalo Technology product, please contact Buffalo Technology.

Memory and Flash Memory Replacement Procedures

If product arrives damaged, save the product and the original packaging, notify Buffalo Technology's Customer Service at 1-800-933-6113 immediately to obtain a Return Merchandise Authorization (RMA) number.

A Return Merchandise Authorization (RMA) is required for replacing product. RMA numbers are valid for 14 days from date of issuance. Please ensure that the RMA number is visible on your return packing label. Any return or exchange without the valid RMA number will NOT be accepted. Buffalo Technology reserves the right to refuse any return due to an expired RMA number, no RMA number on shipping label or incomplete items including anti-static packaging.

For your protection, we recommend you fully insure your return shipment in case it is lost or damaged and use a carrier that can provide you with proof of delivery and tracking number. Recommended carriers include UPS and Federal Express. All items must be 100% complete and in "good as new" condition. Returned item(s) must be enclosed in anti-static packaging. Shipping and insurance charges are not refundable.

Entire Agreement

These terms and conditions, including those on the face hereof, constitute the entire agreement with regard to this sale and expressly supersede and replace any prior or contemporaneous agreements, whether written or oral, relating to said sale, including any terms and conditions on any of customer's documents or purchase orders. This agreement shall be binding upon the heirs, successors and assigns of the parties hereto. If any provision of this agreement shall be held to be invalid or unenforceable, the remainder of this agreement shall remain in full force and effect.
